Appeals Process

The first thing we do when filing an appeal is ask for a stay from the municipal court judge. This will put a hold on all pending consequences and all you to keep your license until an official appeal can be filed. Once we have received a stay, we are ready to begin the appeals process.

We will file a Notice of Appeal with the clerk of the Municipal Court. This notice must be made within 20 days of the entry of judgment in Municipal Court. The Superior Court will review your case. If the Court requests, we will prepare a written brief, which is a summary of the arguments for your appeal, and present it to the Superior Court. Generally, the Superior Court will review the all of the documents and evidence produced at trial and will make their own determination. Generally, new evidence cannot be presented to the Superior Court. Municipal cases are appealed to the superior court. Superior Court cases are appealed to the appellate courts.
